By accessing or using Kudofy ("the Service"), operated at kudofy.io, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
Kudofy provides automated SMS review request messaging services for businesses. The Service allows you to send text messages to your customers requesting Google reviews on your behalf. You are responsible for ensuring you have proper consent from your customers before sending them messages through the Service.
To use the Service, you must create an account and provide accurate and complete information. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
You agree not to use the Service to:
You are solely responsible for complying with all applicable SMS and telecommunications laws and regulations. This includes but is not limited to obtaining proper consent from message recipients, honoring opt-out requests, and including required disclosures in your messages. Kudofy automatically processes opt-out requests (STOP messages) but you remain responsible for overall compliance.
Paid plans are billed monthly in advance. You authorize us to charge your payment method on file for all fees associated with your plan. If payment fails, we may restrict access to the Service until payment is resolved. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not provide refunds for partial months of service.
New accounts receive a 14-day free trial with full access to the Service. No credit card is required during the trial period. At the end of the trial, you must select a paid plan to continue using the Service. If no plan is selected, your account will be restricted but your data will be preserved.
The Service, including its design, features, and content, is owned by Kudofy and protected by applicable intellectual property laws. You retain ownership of any content or data you provide through the Service, including customer information and message templates.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Kudofy shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold harmless Kudofy from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these terms, or your violation of any applicable law or regulation, including SMS compliance laws.
We may suspend or terminate your account at any time if you violate these terms or use the Service in a manner that could harm other users or the Service itself. You may delete your account at any time through your account settings. Upon termination, your data will be permanently deleted.
We may update these terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated terms.
